Your Landlord May Be LIABLE FOR Carbon Monoxide Exposure

California Law Requires Landlords to Maintain Safe Living Conditions

California law requires landlords to keep rental units in a safe and livable condition. If a landlord failed to maintain gas appliances, ventilation systems, or required safety devices, that failure may support a legal claim.

We’ve Recovered Millions for Tenants in Unsafe Homes

Castelblanco Law Group has spent decades representing tenants harmed by unsafe housing conditions. Our firm has recovered over $200 million for clients, including people injured because landlords failed to keep rental homes safe.

How Carbon Monoxide
Poisoning Happens in Rental Homes

Many tenants are exposed to carbon monoxide because something in the home was not properly maintained. In many cases, the danger could have been prevented with timely repairs, inspections, and safe property management.

Common Sources of Carbon Monoxide in Apartments

Common sources include gas stoves, ovens, furnaces, wall heaters, water heaters, fireplaces, and other fuel-burning appliances. Carbon monoxide can also build up when vents, flues, or exhaust systems are blocked or damaged.

How Poor Maintenance Leads to Dangerous Exposure

Broken appliances, poor ventilation, missing detectors, ignored repair requests, and delayed maintenance can all create dangerous exposure risks. When a landlord fails to address those issues, tenants may be left in unsafe conditions without knowing it.

Who Is Responsible — Landlord, Property Manager, or Both?

Responsibility depends on the facts of the case. In some situations, the landlord may be liable. In others, a property manager, maintenance company, or another party may share responsibility for the unsafe conditions.

Symptoms and Health Risks of Carbon Monoxide Exposure

Carbon monoxide poisoning can affect the body quickly or over time, depending on the level of exposure. The symptoms may start mildly, but the health consequences can become serious if the danger continues.

Physical Symptoms: Headaches, Fatigue, Nausea

Common symptoms include headaches, dizziness, weakness, nausea, confusion, chest discomfort, and unusual fatigue. Because these symptoms can resemble other illnesses, many tenants do not realize carbon monoxide may be the cause.

Long-Term Damage: Brain Injury, Heart Issues, Death

Severe exposure can deprive the brain and body of oxygen. In serious cases, carbon monoxide poisoning may lead to neurological damage, heart problems, loss of consciousness, or death.

Carbon Monoxide Exposure and Mental Health Impacts

Living through a dangerous exposure can also leave lasting emotional effects. Many tenants experience anxiety, fear, sleep disruption, and ongoing stress after discovering they were living in unsafe conditions.

Do You Have a Case Against Your Landlord?

Many tenants are not sure whether a rodent problem rises to the level of a legal claim. If the infestation was serious, ongoing, or ignored by the landlord, you may have grounds to take legal action.

WHO WE HELP

Our legal team is dedicated to representing victims of landlord negligence. We frequently help:

Families in older apartments (built before 1978) with peeling or chipping paint.

Parents of children with a confirmed blood lead level test.

Renters whose landlords ignored requests to fix unsafe conditions.

Families living in Section 8 or other subsidized housing.

Tenants who were not given a lead hazard disclosure form before moving in.

WHAT MAKES A STRONG CASE

While every case is unique, a strong lead poisoning claim typically includes:

Proof of Lead

Evidence of lead paint in your home.

Proof of Exposure

A blood test showing elevated lead levels in your child.

Landlord Negligence

Proof that your landlord knew or should have known about the hazard and did nothing.

Do You Have a Case Against Your Landlord?

Many tenants are not sure whether their situation qualifies for legal action. If the exposure happened because unsafe conditions were ignored, you may have a claim against the landlord or another responsible party.

When You Can Sue for Carbon Monoxide Poisoning

You may have a claim if your landlord knew or should have known about unsafe conditions and failed to fix them. Missing detectors, broken appliances, ignored complaints, code violations, and unsafe repairs may all help support a case.

What If You Don’t Have a CO Detector or Medical Proof?

You should still speak with a lawyer. Many tenants do not have complete documentation, especially if they did not know carbon monoxide caused their symptoms at the time. Our team can help investigate the source of exposure and gather supporting evidence.

What Makes a Strong Carbon Monoxide Legal Claim

A strong claim often includes proof of unsafe property conditions, evidence of landlord negligence, medical symptoms or treatment, and a timeline connecting the exposure to the harm suffered. Even if you are missing some of that information, we can review your situation and explain your options.

What You Can Recover in a Lawsuit

A carbon monoxide lawsuit may involve more than medical costs alone. If your landlord’s negligence caused the exposure, you may be able to recover compensation for several types of losses.

Compensation for Medical Bills, Pain, and Emotional Distress

You may be entitled to compensation for emergency care, hospital visits, follow-up treatment, medication, pain and suffering, and emotional distress related to the exposure.

Coverage for Moving Costs or Property Damage

If you had to leave the property, replace belongings, lose income, or pay to relocate, those losses may also be part of your claim.

Help Breaking Your Lease or Getting Repairs Ordered

In some situations, legal action may help you break your lease, force repairs, or hold the landlord accountable for failing to make the property safe.

FREQUENTLY ASKED QUESTIONS

What is carbon monoxide and where does it come from?

Carbon monoxide (CO) is a toxic gas you can’t see or smell. It forms when fuel does not burn the right way. In homes and apartments, it can come from things like gas stoves, ovens, furnaces, water heaters, fireplaces, space heaters, portable generators, and car exhaust—especially when ventilation is blocked or equipment is not maintained properly.

What should I do if I suspect carbon monoxide in my home?

Leave the home right away and get to fresh air. Call 911 or your local emergency number, and get medical attention if anyone feels sick. Once you are safe, report the problem to your landlord or property manager in writing and keep copies. If possible, take photos or video of the appliance area, vents, detectors, or anything that looks damaged or blocked.

How do I prove carbon monoxide caused my health issues?

We build carbon monoxide cases by tying together medical proof with property evidence. That can include medical records, symptoms consistent with CO exposure, and documentation showing where the gas came from—such as maintenance history, prior complaints, inspection findings, ventilation problems, or code violations. In many cases, expert input helps explain how the exposure happened and why it caused the injuries.

What if I didn’t go to the hospital right away?

You can still have a case. Many people do not realize what is happening because carbon monoxide symptoms can look like the flu, fatigue, or a headache. The most important step is to get evaluated as soon as possible and tell the provider you suspect CO exposure. We can still use your timeline, your symptoms, witness statements, and property records to show what happened.

Do I need to go to court or can this be settled?

Many carbon monoxide cases resolve through a settlement once the evidence is clear and the responsible parties understand the risk they face. If they refuse to do the right thing, we prepare every case as if it will go to court and we are ready to litigate.
