Bed Bug Infestation

What does bed bug infestation mean?

A bed bug infestation occurs when bed bugs are living and reproducing inside a rental home, building, furniture, or personal belongings.

Possible signs include:

  • Live bed bugs in mattresses, furniture, or wall openings.
  • Small reddish-brown spots on bedding or mattresses.
  • Shed skins, eggs, or empty eggshells.
  • Repeated bite-like marks appearing after sleep.
  • A sweet or musty odor in heavily infested areas.

Bites alone do not confirm an infestation because other insects and skin conditions can produce similar marks. A qualified pest-control professional can inspect the property and identify whether bed bugs are present.

California landlords cannot knowingly show, rent, or lease a vacant unit with an active bed bug infestation. They must also provide tenants with written information explaining bed bug identification and how suspected infestations should be reported. California Civil Code §§ 1954.602–1954.603

Why does a bed bug infestation matter to tenants?

Bed bugs are not known to spread disease to people, but their bites can cause itching, irritation, allergic reactions, and skin infections resulting from excessive scratching. Living with an infestation may also contribute to sleep loss and anxiety. Centers for Disease Control and Prevention

Bed bugs can move between units and travel on furniture, clothing, luggage, and other belongings. Effective treatment may therefore require inspections of surrounding apartments and cooperation from multiple tenants.

California tenants must cooperate with authorized inspections and provide information needed for detection and treatment. Landlords must give inspected tenants the pest-control operator’s findings in writing within two business days after receiving them. If a common-area infestation is confirmed, all tenants must receive the findings. California Civil Code §§ 1954.604–1954.605

When should you speak to a lawyer?

Consider speaking with a California habitability lawyer if:

  • Your landlord ignores a written report of suspected bed bugs.
  • Treatment is repeatedly delayed, incomplete, or ineffective.
  • The landlord knowingly rented you an infested unit.
  • You experience documented injuries, property loss, or displacement.
  • Your landlord blames or charges you without evidence or retaliates after your report.

Keep photographs, videos, written complaints, inspection findings, treatment records, medical records, receipts, and a list of damaged or discarded belongings. Follow legitimate preparation instructions so treatment can be completed effectively.

A lawyer can evaluate responsibility, the adequacy of the landlord’s response, and whether the infestation caused legally recoverable harm.
